Following a lengthy investigation into the fatal shooting of Michael Toro on Tuesday, May 5 in Mount Vernon, police arrested city resident Negus Kirton last month.
On Thursday, Nov. 12, Westchester County District Attorney Anthony Scarpino, Jr. announced that Kirton has been indicted on second-degree murder and criminal possession of weapon charges.
Kirton has pleaded not guilty to both charges.
Toro was shot multiple times in the early morning hours on Darling Avenue, police said.
Upon arrival, officers found Toro unconscious with gunshot wounds to his head, back, and arm. He was pronounced dead at the scene.
The shooting launched a joint investigation by the Mount Vernon Police Department Major Case Unit and special agents from the US Bureau of Alcohol, Tobacco, Firearms, and Explosives, leading to the arrest of Kirton at approximately 4 p.m. on Friday, Oct. 2 on North 3rd Avenue.
Scarpino said that Toro and Kirton knew each other before the fatal shooting.
Police noted that Kirton has a long criminal history including arrests for narcotics, assault, weapons possession, and reckless endangerment. He served multiple terms in state prison for more than a decade.
Bail for Kirton, 37, was previously set at $250,000 cash or $500,000 bond. He is scheduled to appear back in court on Wednesday, Nov. 25.
